Service Level Agreement
1. Availability Commitment
StrideTech will use commercially reasonable efforts to ensure 99% uptime for its
monitoring and app services, measured monthly, excluding scheduled downtime and
force majeure events.
2. Scheduled Downtime
Maintenance is typically scheduled between 3 AM and 5 AM Mountain Time with at
least 3 days; notice.
3. Support Services
StrideTech will respond to support requests within 1 business day and resolve errors in a
timeframe deemed reasonable by StrideTech based on severity.
4. Exclusions
Downtime caused by internet issues outside our control, user misuse, third-party services,
or acts of God is excluded.
5. Dispute Resolution
Any disputes shall be resolved through binding arbitration held in Boulder County,
Colorado, unless waived by law.
In the event of any legal action or arbitration proceeding between the parties arising out
of or related to these Terms, the prevailing party shall be entitled to recover its reasonable
attorneys’ fees and costs from the other party, in addition to any other relief to which it
may be entitled.
6. Governing Law
This Terms of Service is governed by the laws of the State of Colorado, United States.
Any disputes arising out of or related to this agreement shall be subject to the exclusive
jurisdiction of the state and federal courts located in Boulder County, Colorado.
