Waiver of Liability and Acknowledgment of Use
Effective Date: May 2025
Applies To: Purchasers and users of the StrideTech Go device and all associated
hardware, software, and services.
1. ACKNOWLEDGMENT OF NON-DIAGNOSTIC PURPOSE
By purchasing and/or using the StrideTech Go device, you expressly acknowledge and
agree that:
- The StrideTech Go is not a medical device and is not intended to diagnose, treat, cure,
or prevent any disease or health condition.
- The device is designed solely to assist with general mobility monitoring and fall risk
awareness.
- Any health-related information provided through the StrideTech Go app or platform is
intended for informational purposes only and does not constitute professional medical
advice.
- The use of this device is entirely at the discretion and risk of the consumer.
2. ASSUMPTION OF RISK
By using the StrideTech Go, you understand and voluntarily accept all risks associated
with the operation and use of the device, including but not limited to:
- The risk that the device may fail to detect or report specific movement patterns or
incidents;- The risk of relying on the device as a safety mechanism without adequate medical
supervision;
- The risk that improper use or configuration of the product could result in
misinterpretation of mobility or safety data.
3. WAIVER AND RELEASE OF LIABILITY
To the fullest extent permitted by law, you hereby agree to waive, release, and discharge
Stride Tech Medical, Inc., its affiliates, officers, employees, agents, and authorized
distributors from any and all claims, losses, liabilities, damages, or expenses (including
attorneys’ fees) arising out of or related to:
- Your use or misuse of the StrideTech Go device;
- Any reliance on data, alerts, or information provided by the device or its associated
software;
- Any personal injury, property damage, or loss resulting from the operation, malfunction,
or failure of the device.
4. LIMITATION OF LIABILITY
In no event shall Stride Tech Medical, Inc. be liable for any indirect, incidental, special,
or consequential damages, or any loss of profits, data, or use, arising out of or in any way
connected with your use of the device.
5. INDEMNIFICATION
You agree to indemnify and hold harmless Stride Tech Medical, Inc. from and against
any and all third-party claims, actions, liabilities, losses, and expenses arising out of or
related to your violation of this Waiver or your misuse of the device.
6. DISPUTE RESOLUTION
Any disputes shall be resolved through binding arbitration held in Boulder County,
Colorado, unless waived by law.
In the event of any legal action or arbitration proceeding between the parties arising out
of or related to these Terms, the prevailing party shall be entitled to recover its reasonableattorneys’ fees and costs from the other party, in addition to any other relief to which it
may be entitled.
7. GOVERNING LAW
This Terms of Service is governed by the laws of the State of Colorado, United States.
Any disputes arising out of or related to this agreement shall be subject to the exclusive
jurisdiction of the state and federal courts located in Boulder County, Colorado.
8. ACCEPTANCE OF TERMS
By purchasing and/or using the StrideTech Go, you confirm that you have read,
understood, and voluntarily accept the terms of this Waiver. Your purchase of the device
constitutes full acceptance of these terms.
